Speks AI, Inc. ("we", "us", or "our") operates the Speks application (the "App"), an AI-powered shopping assistant for Shopify stores. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our App, whether you are a Shopify merchant ("Merchant") or a customer interacting with the chat widget on a Merchant's storefront ("End User").

2. Information We Collect

2.1 Merchant Information

• Shopify store name, domain, and email address (collected during OAuth authorization).
• Product catalog data, collection data, and store policies (synced to power AI recommendations).
• App configuration preferences (widget appearance, messaging, branding settings).

2.2 End User Information

• Chat messages and conversation history exchanged with the AI assistant.
• Email address, if voluntarily provided during a conversation.
• Browsing context such as the current product or collection page being viewed.

2.3 Automatically Collected Data

• Basic analytics data (page views, widget interactions) via Vercel Analytics.
• Device type and browser information for compatibility and performance monitoring.

3. How We Use Your Information

• To provide and operate the AI shopping assistant and product recommendation features.
• To index and retrieve product data for accurate, context-aware responses.
• To display analytics and conversation insights to Merchants on the dashboard.
• To improve, personalize, and optimize the App's performance and accuracy.
• To communicate with Merchants regarding their account, updates, or support requests.
• To comply with legal obligations and enforce our terms.

4. Data Sharing and Disclosure

We do not sell personal information. We may share data with:

• AI and infrastructure providers (e.g., OpenAI, Pinecone) — to process chat queries and power vector search. Data is sent only as necessary for functionality and subject to their respective privacy policies.
• Hosting and analytics providers (e.g., Vercel, Railway) — for application hosting, performance monitoring, and analytics.
• Shopify — as required by the Shopify API Terms of Service for app operation, webhooks, and billing.
• Legal authorities — when required by law, regulation, or legal process.

5. Data Retention

We retain Merchant data for as long as the App is installed and the Merchant account is active. Conversation data is retained to provide conversation history and analytics features. Upon app uninstallation or account deletion, we delete associated data within 30 days, except where retention is required by law.

6. Data Security

We implement industry-standard security measures including encrypted data transmission (TLS/SSL), secure authentication tokens, and access controls. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security.

7. GDPR and International Users

If you are located in the European Economic Area (EEA), United Kingdom, or other regions with data protection laws, you have rights including access, correction, deletion, and portability of your personal data. To exercise these rights, contact us at privacy@speks.ai.

We comply with Shopify's mandatory GDPR webhooks for customer data requests, customer data erasure, and shop data erasure.

8. Shopify App Store Compliance

This App complies with the Shopify API Terms of Service and the Shopify Partner Program Agreement. We access only the Shopify API scopes required for the App to function and do not use protected customer data beyond the purposes described in this policy.

9. Children's Privacy

The App is not directed at individuals under the age of 16. We do not knowingly collect personal information from children. If we become aware that we have collected data from a child without parental consent, we will delete it promptly.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify Merchants of material changes via email or an in-app notice. Continued use of the App after changes constitutes acceptance of the updated policy.
